Witness nearly hit by drunk driver found slumped over wheel in middle of Somerville street

SOMERVILLE — On Saturday, May 11, 2024, at approximately 2:27 a.m., Officer Jorge Morel of the Somerville Police Department was dispatched to 120 Perkins Street following a report that a woman struck a parked vehicle with her car.

Officers Katso and Gianna Ferrara also responded to the scene.

“Upon arrival, I observed a Gray Honda Civic (MA REG #XXXX) registered to Lindsay Beth Magee,” Officer Morel said. “The vehicle was stopped in the middle of the road in Perkins Street. Ms. Magee was standing with Officer Katso.”

Officer Morel noted that the vehicle driven by Magee had “fresh, extensive” damage on the passenger side’s front bumper, which was dangling from the vehicle.

According to police, Lindsay B. Magee, 42, is a resident of 26 Lincoln Street in Somerville.

Standing near Officer Katso and Magee were two men who witnessed the accident; one of the witnesses chose not to reveal his identity.

“I spoke to Ms. Magee first as Officer Katso left with [the witness who identified himself] to find out what Ms. Magee possibly hit,” Officer Morel said.

At this time Officer Ferrara arrived on scene and joined Officer Morel.

“I observed that Ms. Magge’s eyes were glassy and bloodshot red, she was standing unsteady on her feet, and she was swaying,” Officer Morel said. “Ms. Magee immediately told me that she was recording while holding her phone in her hand because she didn’t feel safe in the situation that she was in. When I asked Ms. Magee what had happened tonight, she stayed silent. I asked her multiple times, but she would not answer. I asked her for her name, which she provided.”

When Officer Morel asked Magee where she was coming from, she told him to ask the two men who were on scene.

“I want to note that [the witness who identified himself] was unfamiliar with Ms. Magee or had not spoken to her before tonight,” Officer Morel said. “I asked Ms. Magee if she had hit anything before our arrival, to which she would stay quiet and not answer. After asking multiple times, she said she did not hit any cars.”

Officer Morel then made his way down the street to where the witness who identified himself and Officer Katso were. On the way there, Officer Morel said he didn’t see any damaged vehicles.

The witness, who revealed his identity to Officer Morel, reported seeing Magee slumped over the steering wheel of the car she was driving. He tried to rouse her, and upon waking, Magee appeared intoxicated. To prevent her from leaving, the witness positioned himself in front of her vehicle. However, Magee nearly struck him as she tried to drive off.

“I went back and to Ms. Magee and asked her where she was coming from, she would not answer, and asked me to rephrase the question,” Officer Morel said. “At this point, I asked Ms. Magee to perform a SFST [standard field sobriety test] she asked me what would her options be, Officer Ferrara had to explain Ms. Magee numerous times what would happen if she agreed or refused. Ultimately, she declined.”

Magee was arrested for OUI Liquor and transported to the Somerville Police Department for booking.

At the station, Magee agreed to take a chemical breath test and registered a 0.17% Blood Alcohol Content (BAC) level, which exceeds the state’s 0.08% limit.
