Leominster woman drives by dancing Gardner man, who punches her windows, smashes her cell phone and gets arrested

LEOMINSTER – On the evening of Sunday, January 22, 2023, Officer James McKenna of the Leominster Police Department was dispatched to the intersection of Johnson and Carter streets in order to investigate a reported altercation between two individuals.

“While en route, I was advised the caller had disconnected with 911,” wrote Officer McKenna in his Narrative for the incident. “When I arrived, I spoke with the caller, Amanda Bergeron [name has been changed to protect victim’s identity]. Amanda appeared visibly upset. She stated that the other party fled down Carter Street in a blue Toyota Corolla. She described him as a white male wearing a pink and white sweatshirt in his early 30s. I requested Officer Cedric Crawford check the area with negative results initially. During my interaction with Amanda, Dispatcher Kilty stated that she was able to locate the vehicle’s registration through the 911 recording and broadcasted the registration as MA PC [number redacted to protect the accused].”

After getting the man’s description, Officer McKenna asked Bergeron to describe what happened.

Bergeron, 28, of Leominster, told Officer McKenna that she was driving down Carter Street from Sixth Street to Johnson Street when she saw a blue Toyota Corolla parked “somewhat in the middle of the road.” In close proximity to the vehicle was a man “dancing” in the road.

“She believed the male was ‘on something,’” wrote Officer McKenna in his Narrative.

According to Officer McKenna, Bergeron said that as she approached the stop sign that abuts Johnson Street, the man came up to her vehicle and began punching her windows. That’s when she called 911.

“Amanda stated she then proceeded toward the Frances Drake School,” wrote Officer McKenna in his Narrative. “Upon reaching that area, she reported driving back to Carter Street to see if the male party was still there because she felt enforcement action must be taken.”

The man was still there when Bergeron returned to the area. He allegedly approached her vehicle and punched her windows a second time.

“Amanda stated that some portion of her driver’s side window was rolled down and she was fearful he may shatter the window,” wrote Officer McKenna in his Narrative. “While the window was rolled down the male reportedly reached inside her vehicle, snatched her cell phone from her hands while she was on the phone with the 911 operator and destroyed the phone. I also called Dispatcher Kilty and asked her to walk me through the 911 call which also corroborated what Amanda reported to me.”

Officer McKenna asked if he could take Bergeron’s cell phone in as evidence. Bergeron asked if she could turn her cell phone in tomorrow. Officer McKenna said that was fine and to put her cell phone in his “mailbox” at the station the following day.

After speaking with Bergeron, Officer McKenna went to look for the man in the blue Toyota Corolla.

“As I proceeded down the street, I observed a blue Toyota sedan […] pass me headed in the opposite direction. I observed the operator to be wearing a pink sweatshirt. I reversed directions and activated my emergency overhead lights,” wrote Officer McKenna in his Narrative. “The operator was extremely slow and reluctant to stop. He began incessantly reaching down toward the passenger seat or the crevasse in between the seat and the center console. As a result of his reluctance to stop, immediate furtive movements coupled with my suspicion the operator was involved in multiple felonies, I issued an immediate exit order.”

When Officer McKenna first encountered the man, he said he could smell alcohol on his breath. Officer Crawford observed “small bottles of alcoholic beverage” inside his vehicle as well.

According to Officer McKenna, he identified the registered owner and driver of the vehicle as Wesley Goguen, through his driver’s license. According to court documents, Goguen is a 31-year-old resident of Pearl Street in Gardner who works in sales.

“I asked Wesley what had transpired earlier. Wesley stated that the female caller nearly struck him with her vehicle. He was really not able to provide much more substantive information,” wrote Officer McKenna in his Narrative.

Officer McKenna went to Bergeron’s residential address because her phone was broken.

“I asked Amanda if she could recite one more time what happened to her this evening. Amanda told me the same story that was consistent with the first story she told me,” wrote Officer McKenna in his Narrative.

Officer McKenna then conducted a “show up” by bringing Bergeron back to Goguen’s Toyota so she could identify him.

“We responded back to the location where Amanda stated the male party the police had detained was ‘definitely him,’” wrote Officer McKenna in his Narrative. “She also stated she was ‘100% certain’ the male party standing across from her was the same person involved in the larceny from her person.”

Officer McKenna then asked Goguen “if his memory was refreshed at all.” Through tears, Goguen said once again that that Bergeron almost hit him with her car. He also denied stealing her cell phone.

Goguen was placed under arrest and charged with larceny from a person and vandalizing property.

He was arraigned in Leominster District Court on January 23.

Goguen is scheduled to appear in court again on March 8 for a pretrial hearing.
