North Brookfield man arrested for stalking, bomb/hijack threat of woman who rebuffed advances, violates restraining order day it was issued

LEOMINSTER — On Friday, August 16, 2024, at approximately 10:01 a.m., Officer James McKenna of the Leominster Police Department was dispatched to 142 Water Street, Apartment [number redacted], to speak with Jennifer [last name redacted] regarding alleged threats made against her by a man whose romantic advances she had rejected.

“When I arrived, Jennifer was on the phone with Kelvin Rivera,” Officer McKenna said. “Jennifer advised Kelvin that the police arrived. Kelvin stated that ‘you police, I’m not scared of you [N-word plural], he mentioned ‘the nine.’ He said ‘come get me [N-word] I’m not scared of nobody…you [N-word plural] got nothing on me. This dumb b*tch on the phone don’t got $h*t on me neither.’ It was apparent that no productive dialogue could be maintained with Kelvin and I advised Jennifer to end the call so I could interview her.”

According to police, Kelvin Rivera, 20, is a resident of 8 Walnut Street, Apt. #2, North Brookfield, MA.

Jennifer informed Officer McKenna that she had never dated Rivera and that the events of the past 24 hours were triggered by her decision not to pursue a romantic relationship with him.

“Jennifer stated that she used to be friends with Kelvin’s cousin, but they are no longer friends, but her plutonic relationship with Kelvin remained,” Officer McKenna said. “However, Jennifer stated that about one month ago, Kelvin punched her. She explained that she is unsure of the date the incident transpired, but recalls punching him back. Jennifer was not able to describe many more details than that, but did articulate an assault and battery.”

Jennifer informed Officer McKenna that when she returned home from work the day before, she discovered Rivera inside her apartment. During the unexpected encounter, she told Rivera that she was not interested in pursuing a romantic relationship with him.

“She stated this caused Kelvin to grow angry and she was forced to coax him out of her apartment so she could drive him home to North Brookfield,” Officer McKenna said. “Jennifer stated that on her way out of the building, Kelvin threatened to punch her. Shortly after Kelvin arrived home, she stated that she received a number of texts from him at 5:37 p.m. She produced the text threat and Kelvin stated ‘gonna need cops on speed dial,’ then stated ‘Imma pull up fr.’ In two separate text messages. The contact information saved in her phone was ‘Naldo Waldo.’”

The officer asked Jennifer if she was worried that Kelvin might have a firearm. Jennifer stated that, although she has never seen Kelvin with a weapon and is unsure if he owns one, she is still fearful that he could potentially have one and concerned that he might use it against her.

Officer McKenna stated that Jennifer then showed him a video of a phone conversation she had with Kelvin earlier that day. Jennifer explained that Kelvin has been calling and texting her from various fictitious phone numbers. In the recorded conversation, the number that contacted Jennifer was 774-367-2478.

During the conversation, Jennifer accused Rivera of not owning a firearm. He responded, “That’s the point, that’s what I want—you don’t know everything about me, shorty, you don’t. [N-word], why would I bring my gun around you? Why would I bring my gun around you? You’re a cop caller, bro. I can never trust my gun around you, are you crazy? But you’re about to meet her. You’re about to meet her. You’re about to meet my gun.”

According to Officer McKenna, Jennifer then asked if she will meet “her” and asks Rivera what “her” name is, to which Kelvin replied, “Betty Boo [N-word], yeah Betty Boo, I call her Betty Boo it’s about to meet you.”

Officer McKenna said that at this point in the conversation, Jennifer disclosed to Rivera that she was recording the conversation and Rivera responded saying, “’tell them they can meet my niña too…tell them cops they can suck my d*ck because they not catching me.’ He also stated, ‘if I’m going to go to jail over you, I’m going to give them a reason to lock me up.’ He then said ‘I’m going to give them a reason to put me in jail…I’m going to give them a real good reason.’ He then retracted his conversation and stated that he did not know what he was talking about when she said he was talking about killing her. He also stated ‘that I’m not scared of no police.’ She then told Kelvin that the police were there and he said ‘give them the phone so I can tell them how bad I’m going to smack the $h*t out of you.’”

Officers with the North Brookfield Police Department arrested Rivera on probable cause, Officer McKenna said.

“I transported Kelvin to the Leominster Police Department,” Officer McKenna said. “I did not conduct an interview with Kelvin until after his booking procedure was complete. I read Kelvin his Miranda warning and he stated he wished to speak to me. Kelvin was advised the interview was recorded, was given an opportunity to review the warning card prior to filling it out. The phone number he provided on the card was the same number I was provided by Jennifer for Kelvin.”

During the interview with Officer McKenna at the police station, Rivera clarified with Officer McKenna that his middle name was – in fact – “Arnaldo.” He then said Jennifer was his girlfriend of one-to-two months, adding that he met her through his cousin.

“I asked Kelvin to clarify the assault and battery,” Officer McKenna said. “Kelvin stated that he was arguing with Jennifer while he was at his brother’s house in Worcester. Jennifer picked him up in Worcester and they returned to her apartment. Kelvin explained the pair began ‘playing around.’”

Rivera stated that while they were “playing around,” Jennifer hit him harder than what he considered playful. He said that he then tried to restrain her because of how hard she was hitting him. Rivera claimed that Jennifer struck him in the forehead, which caused his stitches to rip and his forehead to bleed. Rivera added that Jennifer took him home the following day.

“I then asked Kelvin to explain what transpired yesterday,” Officer McKenna said. “He claimed the pair got into a little argument over ice cream. He stated that he fell asleep and while he was asleep, Jennifer’s children ate all of the ice cream in the apartment. Kelvin told me that he was told by Jennifer to be ready when she got home so she could bring him home. He denied threatening Jennifer. I asked him if he texted her yesterday and he admitted to the text messages Jennifer received. He stated he only wanted the police on speed dial so Jennifer could not make false accusations against him. I then asked Kelvin if that was him on the phone when I arrived today to which he told me it was. He claimed that Jennifer told him to go kill himself and made derogatory comments about his grandmother that angered him. Kelvin stated that he does not own a gun, North Brookfield PD searched his house, himself and summoned a K9. He stated he was exaggerating the statements he made about a firearm. He also claimed the term niña is a street term that is used to describe a ‘laser.’ According to urbandictionary.com, a ‘niña’ is defined as ‘a 9mm handgun.’ He did not elaborate on what he meant when he said he would give the police a reason to arrest him.”

Rivera was charged with the following:

  • Bomb/Hijack Threat
  • Stalking

At around 12:50 p.m. that day, (Aug. 16, 2024), Officer Christian Edge accompanied Jennifer to the Leominster District Court, where Judge Mark Noonan issued a restraining order against Rivera on her behalf.

At 5:54 p.m. that day, Officer Mackenson Adescar of the Leominster Police Department was dispatched to Jennifer’s apartment regarding a possible abuse prevention order (209A) violation. When he arrived on scene, Officer Adescar spoke with Jennifer.

“Jennifer informed me that she had a restraining order against the defendant, Kelvin Rivera,” Officer Adescar said. “In box number two of that order, it stated: ‘You are ordered not to contact the plaintiff in person, by telephone, in writing, electronically, or otherwise, either directly or through someone else, and to stay at least 10 yards away from the plaintiff, even if the plaintiff seems to allow or request contact.’”

Officer Adescar said that at 5:15 p.m. on Aug. 16, 2024, Rivera sent a text message to Jennifer that said, “Shay, Shay, I just got bailed out, and I’m in Leominster. I need a ride in at the common.”

“That text message from Kelvin violated the terms of the order,” Officer Adescar said. Adding, “The restraining order was issued on 08/16/24 at 12:50 p.m. and will expire on 08/29/24 at 4 p.m. Lieutenant Ryan P. Daley from the North Brookfield Police Department served Kelvin with a copy of this order. I called the North Brookfield Police Department on the recorded line (extension 509A), requested that officers respond to Kelvin’s address and arrest him for violating his restraining order. A BOLO (Be On The Lookout) was also issued in the Leominster area to arrest Kelvin if the police make contact with him. I am requesting a warrant for Kelvin’s arrest for violating his restraining order.”

In addition to the charges of Bomb/Hijack Threat and Stalking, Rivera was also charged with Violating an Abuse Prevention Order.

Officer Adescar said that at 9 p.m. on Aug. 16, 2024, he was informed that Rivera has been arrested by the Worcester Police Department for the restraining order violation. Leominster Police Officers Avery Benvissuto and Alec Greenwalt went to the Worcester Police Department, picked up Rivera, and brought him back to the Leominster Police Station for booking.

Rivera’ bail was set at $500 cash.

Rivera was arraigned in Leominster District Court on Aug. 19, 2024. He attended a pretrial conference hearing on Sept. 11, 2024. Rivera’s next court date is on Oct. 28, 2024.
