FITCHBURG — Two Fitchburg parents wanted on custodial kidnapping charges have been located and taken into custody in Whitney, Texas, according to Fitchburg police. The five missing children, ranging in age from 9 months to 10 years old, were also found safe and are now in the custody of Texas Child Protective Services.
The Fitchburg Police Department’s Bureau of Criminal Investigation worked alongside multiple law enforcement agencies, including the Massachusetts State Police, the Worcester County District Attorney’s Office, the United States Marshals Service, and the Hill County (Texas) Sheriff’s Office, to bring the case to a resolution.
Authorities had been searching for Ruth Encarnacion and Isael Rivera since earlier this week after Fitchburg police received a missing persons report for Encarnacion on March 3. On March 5, the Massachusetts Department of Children and Families (DCF) reported her five children missing, prompting law enforcement to issue warrants for Encarnacion and Rivera on five counts each of custodial kidnapping.
Although authorities considered issuing an AMBER Alert, they determined the situation did not meet the criteria, as AMBER Alerts are reserved for cases where a child is believed to be in immediate danger of serious harm or death.
The Worcester County District Attorney’s Office and the Massachusetts Department of Children and Families are now coordinating with Texas authorities to arrange for the return of Encarnacion, Rivera, and the children to Massachusetts.
