“Throughout the investigation, the defendant, identified as Brittany Bender, was found to have failed to comply with a court ordered 209a Abuse Prevention Order, Bender did so by contacting the plaintiff, known to the Commonwealth, by way of phone calls. Bender called both the plaintiff’s cell phone and home phone, leaving a message on the home phone’s answering machine,” Officer Juaire said.

According to police, Brittany N. Bender, 36, resides at 15 Russell Calvin Drive in Worcester, MA. The victim/plaintiff resides at 10 Artemas Avenue in Shrewsbury.

According to police, on Aug. 12, 2024, Brittany called the plaintiff at 2:15 p.m. on their cell phone and called their home phone/voicemail at 2:16 p.m.

“On the phone, the defendant did identify herself both as ‘Brittany Bender,’ and as the ‘Grand-Daughter’ of the plaintiff,” Officer Juaire said. “It was found that the defendant was served with the order on August 9th, 2024, at 8:00 a.m. Bender was served by the UMass Worcester Police Department.”

In his statement of facts, Officer Juaire added that “the victim lives in Shrewsbury and Ms. Bender was known to be in Shrewsbury from 1:46 p.m. to 2:58 p.m. The violation was reported at 3:41 p.m. The victim resides at 10 Artemis Avenue, Shrewsbury, MA.”

Bender was charged with two counts of Violate Abuse Prevention Order and was arraigned in Westborough District Court on Aug. 13, 2024. Following her arraignment, she was released on her own personal recognizance under the condition that she stay away from/not contact the victim and otherwise abide by the restraining order.

Bender’s next court date is a pretrial hearing scheduled for Oct. 10, 2024.
