โ€œOfficer David Aukstikalnis of the Phillipston Police Department had earlier in the shift stopped Cyrus’ motor vehicle, a 2020 gray Subaru Impreza bearing Massachusetts Registration number [number redacted], on State Road near Baldwin Hill Road in Phillipston at 8:03 p.m., and gave him a verbal warning for [a] marked lanes [violation], Cyrus then left going west in the direction of Athol,” Officer Matson said.

โ€œUpon arrival at [number redacted] Patriots Road, we spoke with a female party identified as Linda [last name redacted] who informed us that she called Templeton police to report that her 72-year-old husband identified as William [last name redacted] had been assaulted by their grandson Cyrus,โ€ Officer Matson said. โ€œLinda stated that she was not home during the incident but reported it once she arrived home and found that William had been attacked.”

The officers entered the residence and spoke with William in the living room, where he explained that Cyrus had come home around 7:45 p.m. William told police that while he was in the living room holding a beer, visibly intoxicated, Cyrus asked him what was going on with Ayden, his younger brother. Cyrus then began yelling at William before pushing him, causing William to lose his balance and fall onto the couch, where Cyrus twisted William’s left arm.

William then fell from the couch onto the floor, where Cyrus got on top of him and pushed William’s face into the ground while pinning him down. Cyrus then put his fingers into William’s mouth and started pulling forcefully. After the altercation, Cyrus left the house.

Officer Matson said that he saw blood on Williamโ€™s t-shirt, bruising on his left arm, and he had open cuts on his left hand which were bleeding. In addition, the left side of William’s bottom lip was bruised and his right leg had visible scrapes on it.

Officer Sturgis called Templeton Fire Ambulance to the scene to evaluate Williamโ€™s condition.

โ€œI took photographs of William’s injuries on my Templeton Police Department cell phone,โ€ Officer Matson said. โ€œWe were also advised that Cyrus had made suicidal statements earlier in the day and mentioned suicide by cop.”

Officer Matson then called Templeton Police Dispatch and asked them to issue a BOLO [Be on the Lookout] for Cyrus and informed them that he had probable cause to arrest Cyrus for arrest for domestic assault and battery.

Shortly after, Templeton Fire Ambulance arrived on scene and evaluated Williams’s condition, Officer Matson reported. William signed a medical refusal form from EMS personnel and was advised to seek further medical care if his condition worsened.

Officer Matson said that while he was on scene, a family member of Cyrusโ€™ who lives in Winchester, New Hampshire, called Linda and informed her that Cyrus was at his residence.

โ€œI reached out to the Winchester New Hampshire Police Department and spoke with Officer [David] Rice, I advised him of the situation, and he informed me that he would be checking on Cyrus, however, he could not arrest him without an extraditable warrant,โ€ Officer Matson said. โ€œHe told me that he would check his well-being based on past suicidal statements.โ€

Officer Matson said that Officer Sturgis read William his Domestic Violence (209A) Notice of Rights and advised him on how to obtain a restraining order.

โ€œWilliam signed the notice after being read his rights,โ€ Officer Matson said. โ€œLinda stated that they would go to Winchendon District Court in the morning to apply for a restraining order, and declined an emergency restraining order. William filled out a Templeton Police Department Witness Statement Form documenting the assault, with the help of his wife Linda, and William signed the statement. Linda also filled out a Templeton Police Department Witness Statement Form detailing Cyrus’s mental health, and substance abuse history. I also advised her that she could petition the Winchendon District Court for a Section 35 based on his substance abuse history.โ€

At this time, Officer Matson and Sturgis left the residence and returned to the Templeton Police Station.

When he returned to the station, Officer Matson called Officer Rice from the Winchester New Hampshire Police Department, who said that he made contact with Cyrus.

โ€œHe said that he did not have enough to Section 12 Cyrus based on what he observed on scene,โ€ Officer Matson said. โ€œHe also told me that Cyrus stated to him that he would be going to the Winchendon District Court in the morning to speak with his probation officer regarding the incident.โ€

On Thursday, Sept. 12, 2024, at around 8:30 a.m., Cyrus arrived at the Templeton Police Station. Officer Matson escorted him to the interview room, read him his Miranda rights, which Cyrus acknowledged and confirmed by signing the Miranda warning card.

โ€œHe informed me that when he came home his grandfather, William, got into his face, then Cyrus grabbed onto him and restrained him,โ€ Officer Matson recounted. โ€œCyrus also filled out a Templeton Police Department Witness Statement Form. After speaking with him, I informed him he was under arrest for the incident. Cyrus was booked at the Templeton Police Station and then transported to the Winchendon District Court.โ€

Cyrus was charged with Assault & Battery on +60/Disabled.

His bail was set at $5,000.

Cyrus was arraigned in Winchendon District Court on Sept. 12, 2024. Following his arraignment, Cyrus was released on bail with an ankle GPS monitor with exclusion zones under the condition that he stay away from/not contact the victim, commit no new crimes, and possess no firearms, destructive devices, or dangerous weapons.

On Oct. 10, 2024, Cyrus attended a pretrial hearing during which the charge of Assault & Battery on +60/Disabled was amended to Assault & Battery by Judge Mark Goldstein. Cyrus plead guilty to the amended charge and Judge Goldstein placed him on probation with administrative supervision until Oct. 16, 2025.
