“It was found out later that [a woman] was attempting to get property from her ex-boyfriend, Mark Ciccone,” Officer Labell said. “Upon arrival to the area, I went up the front steps of the building but the door was locked.”

Officer Labell said that as he began to walk around the apartment building to another entrance, a male later identified as Corey [last name redacted] approached him.

“Corey identified himself as the husband of Mark’s sister, Emily Civita, who also lives in the apartment,” Officer Labell said. “While speaking with Corey, [Ciccone’s ex-girlfriend] pulled up on the street.”

Officer Labell asked Corey to wait in his vehicle while he went to speak with Ciccone’s ex-girlfriend.

“I went over to speak with [Ciccone’s ex-girlfriend],” Officer Labell said. “[Ciccone’s ex-girlfriend] informed me she showed up to grab her belongings. I asked [Ciccone’s ex-girlfriend] if she lived there and she stated no. I was informed by [Ciccone’s ex-girlfriend] that she has a restraining order against Mark. [Ciccone’s ex-girlfriend] advised me that I would need an additional officer. Officer John Ramos was already en route to the location.”

Officer Labell said that Ciccone’s ex-girlfriend told him that Ciccone wasn’t there at the moment.

“I informed [Ciccone’s ex-girlfriend] that if he was going to be a while that we would schedule it for a future day and time that works for them,” Officer Labell said.

Ciccone’s ex-girlfriend asked Officer Labell to ask Corey if he knew when Ciccone would arrive, so Officer Labell went back to Corey’s location.

“I asked him if he knew when Mark would be home,” Officer Labell said. “As soon as Corey was telling me what time that he thought Mark would arrive, Mark pulled up onto Florence Street. I began walking over to the vehicle Mark pulled up in. Mark stepped out, and said ‘Get the f*ck off my property.’ I asked Mark to calm down and he stated, ‘Get the f*ck off my property,’ again. Mark began yelling at me more, [stating], ‘I don’t give a f*ck.’”

Officer Labell requested a street supervisor respond to his location.

“Mark then yells at [his ex-girlfriend], ‘Keep videotaping, bro! Keep videotaping [n-word], because you all will have to shoot me,” Officer Labell recounted. Adding, “[He then] yelled at [his ex-girlfriend], ‘You were on my property all f*cki*g day!’ At this point, Mark violated the restraining order in front of myself and Officer Ramos and was arrestable.”

According to police, Mark J. Ciccone, 37, is a resident of 312 Lancaster Street in Leominster.

Officer Labell said that – at this time – Ciccone was displaying an “assaultive behavior” because he was walking toward the officers with his fists clenched. Officer Ramos responded by pulling out his taser and activating its light display.

“Mark then yelled, ‘f*cking tase me, f*cking tase me,’” Officer Labell said. “Mark then threw his wallet clip behind him, causing everything in it to fall out onto the ground. Mark continued to yell and Officer Ramos and myself attempted to de-escalate the situation.”

Officer Labell informed Ciccone that he was under arrest for violating the restraining order.

“Mark began to back up, and yelled at [his ex-girlfriend] again, ‘You did this sh*t to me! You did this sh*t to me! You did this sh*t to me!’” Officer Labell said. “Mark continued to back up towards his vehicle. Mark continued to yell at [his ex-girlfriend] while I attempted to give him commands that he was under arrest and needed to place his hands behind his back. Mark began to calm down. Mark stopped yelling and then turned towards officers and began clenching and opening his fists. I gave Mark more commands and he continued to yell and clench his fists. Officer Ramos warned Mark that he would tase him, and Mark asked to be tased.”

Officer Labell told Ciccone to turn around and place his hands behind his back.

“Mark finally began to comply and turned around. Mark put his left wrist behind his back and I was able to put the handcuff on,” Officer Labell said. “Mark then put his right wrist behind his back. I attempted to put the handcuff on but there was a bracelet under the sweatshirt and the handcuff wouldn’t fit. Mark then got upset and began yelling at other officers and tried walking away from me. Mark was able to pull his right wrist away. Officers on scene had to wrestle Mark to the ground. Mark was still not compliant. Ofc. Rice administered a drive stun to Mark. Mark then placed his right wrist behind his back. We were able to place a second set of handcuffs on Mark.”

Once Ciccone was in custody the officers picked him up from the ground.

“Mark stated that he had a heart condition,” Officer Labell said. Adding that one of the responding officers called for an ambulance to check on him.

Officer Labell said that while officers were conducting a pat frisk of Ciccone, he heard yelling coming from the direction where Ciccone’s ex-girlfriend was sitting in her car.

“I turn around and see a female punching the passenger window and making threats towards [Ciccone’s ex-girlfriend],” Officer Labell said. “The female, later identified as Emily Civita, is yelling, ‘Open your f*cking door.’ I rush down the hill with multiple other officers. Emily then punches the driver side window and yells, ‘I’m going to f*ck you up.’”

According to police, Emily Civita, 31, is a resident of Mechanic Street in Leominster.

Officer Labell said that he took control of Civita’s right arm while another responding officer took control of her left arm.

“Emily yells, ‘I’m going to f*ck you up,’ again,” Officer Labell said. “Emily was placed under arrest for Vandalism. Officers placed handcuffs on Emily’s wrists without issue.”

Civita was then escorted to a police cruiser and placed in the prisoner compartment.

“I was then informed that Mark’s thirteen-year-old daughter, [name redacted] was upstairs in apartment [number redacted],” Officer Labell said. “I asked Mark if he was okay with Corey staying with her and he stated, yes. Corey then approached me and asked where Emily was going and I informed him the Leominster Police Station. [Ciccone’s ex-girlfriend] then rolls down her window and says she wants to press charges for Emily hitting her car. I informed [Ciccone’s ex-girlfriend] that she was already placed under arrest for that.”

Officer Labell asked Ciccone’s ex-girlfriend to go to the Leominster Police Station so he could speak with her there. At this time, the ambulance arrived on scene to check on Ciccone.

While the EMTs were checking on Ciccone, Officer Labell said that Civita began having a panic attack in the prisoner compartment of the cruiser she was in. Two other responding officers opened the door of the cruiser and attempted to calm her down.

“Fire/EMS finished checking on Mark and came down to check on Emily,” Officer Labell said. “Soon after, Emily had calmed down and was ready to be transported.”

Officer Labell said that once the scene had calmed down, he looked around and noticed several people standing on the front porches of various buildings along Lancaster Street observing the situation.

Officer Labell said that traffic on Lancaster Street also came to a standstill as a drivers stopped to observe the commotion, which caused a backup.

Civita and Ciccone were then transported to the Leominster Police Station for booking.

“When the scene was clear, I went back to the police station to speak with [Ciccone’s ex-girlfriend],” Officer Labell said. “[Ciccone’s ex-girlfriend] was waiting out front. I informed [Ciccone’s ex-girlfriend] that I needed to take a picture of the passenger window that Emily punched for the report. I then asked [Ciccone’s ex-girlfriend] if she was in fear when Emily was punching the window and threatening her and she stated yes. I advised [Ciccone’s ex-girlfriend] that both were arrested and that Emily would be eligible for bail. I advised that Mark would not be eligible because he violated the restraining order. I advised [Ciccone’s ex-girlfriend] that she would receive a summons in the mail for court at a future date. I advised [Ciccone’s ex-girlfriend] to not go to Mark’s residence.”

Officer Labell told Ciccone’s ex-girlfriend that if she needed to get her belongings to come to the police station to schedule a date and time.

“If Mark refuses then she will have to get an order from the judge to get her belongings,” Officer Labell explained. “[Ciccone’s ex-girlfriend] has a restraining order against Mark and went to the address not accompanied by Police which escalated the situation.”

Ciccone was charged with:

  • Abuse Prevention Order, Violate
  • Disorderly Conduct
  • Resist Arrest

Civita was charged with:

  • Disorderly Conduct
  • Assault
  • A Vandalism charge was ultimately removed from the complaint application because no visible damage was done to Ciccone’s ex-girlfriend’s car when Civita punched it, according to a Supplemental Narrative of Sergeant Matthew Fallon.
