Sex offender panhandling at Leominster CVS arrested for failure to register

LEOMINSTER โ€” On Friday, Oct. 3, 2025, at approximately 4:40 a.m., Officers Carmen Garcia and Carlos Crespo-Delgado of the Leominster Police Department were dispatched to the CVS located at 9 Nelson Street following a report of an unwanted guest.

โ€œDispatch advised responding units that the unwanted guest was identified as Nicholas Barrieault,โ€ Officer Garcia said. โ€œCVS employees wanted Nicholas removed from the property.โ€

According to police, Nicholas J. Barrieault, 40, is homeless in Boston, MA.

Officer Garcia said that there was probable cause for Barrieaultโ€™s arrest for allegedly failing to register as a sex offender as of May 23, 2025.

Officer Garcia stated that failing to register as a sex offender is a felony in the Commonwealth of Massachusetts, and that he became aware of this when officers were previously called at approximately 2:30 a.m. to assist Barrieault with his walker.

โ€œUpon arrival, officers met with Nicholas, and he was subsequently placed under arrest. I explained to Nicholas he was under arrest for violation to register as a sex offender,โ€ Officer Garcia said. โ€œNicholas did not resist officers while he was placed in handcuffs and secured, they were double-locked.โ€

Officer Crespo-Delgado transported Barrieault to the Leominster Police Department for booking.

Officer Garcia then went inside the CVS to speak with the reporting party, a male employee.

The reporting party said Barrieault had been in the store for more than an hour, during which time he approached customers and panhandled for money.

โ€œ[The reporting party] approached Nicholas and asked him to leave,โ€ Officer Garcia said. โ€œNicholas then yelled obscenities at [the reporting party] and was refusing to leave.โ€

The reporting party said he then told Barrieault that if he didnโ€™t leave, he would call the police.

โ€œSince Nicholas refused to leave the property after he was asked to leave, [the reporting party] ultimately called emergency services,โ€ Officer Garcia said.

The reporting party requested that Barrieault be trespassed permanently from the CVS at 9 Nelson Street.

Nicholas Barrieault was arrested and charged with:

  • Sex Offender Fail to Register, Subsequent Offense, Level 2 or 3

In his report, Officer Garcia listed the following arraignment dates for Barrieault for failure to change his address as a sex offender:

  1. July 20, 2023 โ€” Fitchburg District Court: Barrieault was found guilty and sentenced to nine months committed, with 127 days deemed served.
  2. Dec. 7, 2022 โ€” Fitchburg District Court: Barrieault was found guilty and sentenced to six months committed, with 106 days deemed served.
  3. Oct. 11, 2019 โ€” Leominster District Court: Barrieault was found guilty, and the case was filed, meaning no immediate sentence or penalty was imposed and the matter was set aside without further court action unless another offense occurs.

Officer Garcia also trespassed Barrieault from 9 Nelson Street (CVS).

Barrieault was arraigned in Leominster District Court on Oct. 3, 2025. Following is arraignment, Barrieault was released on $1,000 bail under the condition that he register as a sex offender within 24 hours.

During a probable cause hearing on Nov. 3, 2025, Barrieault pleaded guilty to the charge of failure to register as a sex offender (subsequent offense) and was sentenced to 10 months in jail.
