Leominster woman’s report of past domestic assault leads to her arrest and that of longtime partner

LEOMINSTER — On Wednesday, November 26, 2025, Leominster Police Officer Nicholas Rice was dispatched to the lobby of the police department to speak with a woman who wanted to report a past domestic assault and battery incident.

“Upon arrival, I spoke with the reporting party, Donna Wilson,” Officer Rice said. “I asked Donna what brought her in tonight and she responded with ‘Alright, so who I live with, um, he’s Spanish and he’s been getting like very verbally violent with me.’”

According to police, Donna J. Wilson, 64, is a resident of Leominster, MA.

Wilson told Officer Rice that on Nov. 25, 2025, her live-in partner, later identified as Hector Pena, 61, picked her up by the forearms and threw her against her bed.

“I asked who Hector was to her, and she stated that due to this incident he is her ex-boyfriend; however, later in the call she advised me that they have been dating for thirteen years,” Officer Rice said. “Donna specifically requested that when I speak to Hector on this matter that I do not allow her daughter to be there and called her daughter a ‘rough a$$ wench,’ and insinuated that Hector and her daughter are possibly sleeping together.”

Officer Rice said he then asked Wilson where the assault occurred, and she stated it took place in her bedroom.

“Donna stated the argument occurred because she took Hector’s debit card due to her being angry with him,” Officer Rice said. She stated that Pena came into her room and took her phone from her, and her daughter came in after hearing the yelling.

“Donna then stated again that her daughter was going to vouch for Hector and asked me again to not talk to her,” Officer Rice said.

Officer Rice said he explained to Donna that he would speak with anyone involved in the case, or anyone who may have been a witness, in case they had exculpatory evidence.

“I explained that I needed to do my due diligence as a police officer,” Officer Rice said. “Donna stated that it wasn’t fair.”

Officer Rice said he then went to get an evidence camera to document her bruises.

“Donna had bruises on her forearms,” Officer Rice said, adding that he filled out the domestic violence paperwork with her.

“During this, I was asking where her phone was when he took it,” Officer Rice said. “Donna could not give me a straight answer. Due to the inconsistencies in her statements, I advised her that I would like her to write down everything she told me on a voluntary statement form.”

Officer Rice said he provided Wilson with the voluntary statement form and she began writing her statement.

“She was unsure of where her phone was during the incident when Hector took her phone,” Officer Rice added. “I advised her that Hector would be placed under arrest. Donna declined a restraining order at this time, and she wrote her statement alone in the room.”

Officer Rice said that he and Officer Noad DeCesare then wen to the address where the incident allegedly occurred.

“I spoke with Hector and asked him if there was an altercation yesterday. He said nothing happened other than her taking his phone and throwing it up against the wall,” Officer Rice said.

Officer Rice said he asked Pena to walk him through what happened. Pena said that he went into Wilson’s bedroom because she took his credit card and his keys.

“He stated that he took her phone as collateral until she returned his stuff,” Officer Rice explained.

Officer Rice asked Pena if anything became physical between him and Wilson, and he stated that it did not.

“He then stated that Donna’s daughter, Danielle, walked into the room during the argument,” Officer Rice said. “Hector stated that Donna raised a hand to Danielle, but was unsure if it was in a closed fist or an open hand.”

Officer Rice then asked Pena if he could get Danielle so she could speak with him and Officer DeCesare, and he did.

“Prior to me interviewing Danielle, Hector stated this was a false claim and asked if he could press charges against Donna,” Officer Rice said. “He referenced a previous call that I was the primary officer on a few months prior.”

During that call, Wilson reported that she was locked out of the house and experiencing verbal abuse.

“The outcome of that previous call was that Donna suffers from addiction of alcohol and was intoxicated that night when she called,” Officer Rice said.

Officer Rice said he then spoke with Danielle and asked her to walk him through what happened.

“She stated that she heard Donna yelling at Hector so she went into the room,” Officer Rice said.

Danielle added that she knows what type of person her mother is and stated that her mother had lied about her biological father and her sister’s biological father hitting her, adding that she was “crying wolf,” Officer Rice reported.

“She stated that she was trying to play ‘peacemaker’ for this situation and both Hector and Donna were accusing each other of taking each other’s belongings,” Officer Rice said. “Danielle then stated that Donna approached her and pushed her. I asked if she saw anything physical happen between Hector and Donna and she stated no. I explained a Section 35 to Danielle and how to protect herself from Donna in future interactions. I advised her to just record their interactions so she cannot become a victim of a false allegation.”

A Section 35 is a civil process under Massachusetts General Laws, Chapter 123, Section 35 that allows a court to involuntarily commit someone to treatment for an alcohol or substance use disorder when their use creates a “likelihood of serious harm” to themselves or others. Under this law, a qualified petitioner, such as a police officer, physician, spouse, blood relative, guardian, or court official, may file a petition asking a court to order someone into a licensed treatment facility.

“I then called Lieutenant [Thomas] Wade and explained that I was going to arrest Hector based on Donna’s claims and informed him of the new allegations against Donna by Danielle,” Officer Rice said. “We agreed that since it’s a different victim, Donna would also be placed under arrest.”

Office Rice said he then went and spoke with Pena again.

“He asked that I documented in the report that Donna took his debit card, credit card, and keys to the house,” Officer Rice recounted. “I told him that I would do so. I then informed him that based on the statements made, that I would need to place him under arrest. He was upset and stated that he never touched her. I explained that just on the allegations, I had no choice in the matter.”

Officer DeCesare then handcuffed Pena and transported him to the Leominster Police Department for booking.

“I remained on scene with Danielle and Hector’s daughter,” Officer Rice said. “I filled out the domestic violence paperwork with Danielle. After a long discussion on the matter, she declined a restraining order. Officer DeCesare and I then went down to the 110 Grille (where Donna told me she would be drinking tonight) and spoke with Donna. I told Donna she was going to be placed under arrest for domestic assault and battery.”

Officer Rice then placed Wilson in handcuffs and transported her to the station for booking.

Hector Pena, 61, was arrested and charged with:

Wilson was arraigned in Leominster District Court on Nov. 28, 2025, at which time Judge Richard Eustis denied the Commonwealth’s motion to revoke bail. Following her arraignment, Wilson was released on $200 cash bail under the condition that she wear a SCRAM alcohol testing ankle monitor, remain alcohol free, and comply with the abuse prevention order.

Wilson’s next court date is a pretrial hearing scheduled for Jan. 8, 2026.
