LEOMINSTER — On Friday, May 22, 2026, at approximately 4:20 p.m., Officer Renzo Vasconcelos of the Leominster Police Department responded to the McDonald’s located at 247 Mill Street following a report of a fight and a male showing his butt.

Leominster Police Officers Marjus Zylyftari and Kyle Abazorius also responded to the scene.
“Upon arrival, I activated my body-worn camera and went into McDonald’s,” Officer Vasconcelos said.
“Inside, an employee told me, ‘He is outside, right over there,’ and pointed to the entryway at the front of the building. I then walked over there, where I encountered an individual who was later identified as Zachary Devito.”
According to police, Zachary C. Devito, 34, is a resident of N Main Street, Leominster, MA.
“I asked Zachary what happened and he would not tell me,” Officer Vasconcelos said. “Zachary appeared to be under the influence of alcohol as he was slurring his speech and stumbling around. I radioed dispatch and had them send EMS. Zachary’s nose was red like he had received a punch to his face, and he was drunk.”
Officer Vasconcelos said that while attempting to get Devito to tell him what happened, he kept putting his hands in his pockets.
“I advised Zachary not to put his hands in his pockets, or he would be placed in handcuffs,” Officer Vasconcelos said. “Zachary then placed his hands back into his pockets, saying he needed a lighter, which is when I placed Zachary in handcuffs for my safety and his.”
Officer Abazorius then double-locked the handcuffs.
“Since Zachary was not cooperating with me, I went inside and spoke with the McDonald’s manager, Chelsea,” Officer Vasconcelos said. “Chelsea said that she heard people fighting in the lobby, so she called the police. I asked Chelsea if she saw anything and she said no. Chelsea told me that she just knew it was two teenagers and the guy (Zachary). Chelsea then pointed out the two teenagers, who were currently speaking with Officer Zylyftari, and said they were the ones involved.”
Officer Vasconcelos said he then went outside and spoke with the two teenagers. One of the teenagers, who had visible injuries to his face, told Officer Vasconcelos that he and his friend were at McDonald’s when “the guy” (i.e., Devito), came up to them and started telling them to go outside with him.
“[The teen] said both he and [his friend] kept telling him no, but Zachary kept insisting,” Officer Vasconcelos said. “[The friend] then told me that Zachary kept telling him that he ([the friend]) wants to ‘f*ck him (Zachary) in the butt.’ [The friend] said that, at this moment, Zachary pulled his pants down and showed them his butt.”
Officer Vasconcelos noted that both teens were “disgusted, alarmed, and grossed out by Zachary showing them his butt.”
“[The teen] told me that Zachary then got in his face, spit on him, and that is when [the teen] kicked Zachary to get him away and they started fighting,” Officer Vasconcelos said.
After speaking with the teens, Officer Vasconcelos advised Devito that he was under arrest for open and gross lewdness. Devito was then transported to the Leominster Police Department for booking by Officer Ramos.
“I then went back into McDonald’s and asked Chelsea if there is any video footage,” Officer Vasconcelos said. “Please note, the cameras did not capture the area in which any of the incidents occurred.”
Zachary Devito, 34, of Leominster, was arrested and charged with the following:
- Open and Gross Lewdness (for exposing himself to the teens)
- Assault & Battery (for spitting at one of the teens)
- Assault & Battery (for punching and scratching one of the teens)
Devito was arraigned in Leominster District Court on May 26, 2026. Following his arraignment, he was released on $1,000 cash bail under the condition that he stay away from the victims. Devito’s next court date is a pretrial hearing scheduled for June 18, 2026.
