HAVERHILL — On Thursday, August 6, 2026, at approximately 2:21 p.m., Haverhill Police Officer Benjamin Torrence responded to a residence on Allen Street following a report of a man living there who had been witnessed touching a dog inappropriately.

Haverhill Police Sergeant Michael Mills also responded to the scene.
When Officer Torrence arrived on scene, he was met in the driveway of the residence by the reporting party and his son.
“Both parties looked visibly upset. When asked what had occurred, [the reporting party] stated that he and [his son] called regarding the defendant, Zygmunt Zybert III,” Officer Torrence said. “[The reporting party] stated that he and Zygmunt are friends and coworkers, and that Zygmunt has lived in the residence’s basement for at least 10 years. [The reporting party] stated that before police were called, he received a frantic phone call from [his son] saying that he had woken up from a nap to observe Zygmunt in the second-floor bedroom in his underwear.”
Officer Torrence said that the reporting party’s son corroborated his father’s account and stated that he was awoken by one of the family dogs jumping on him as if to get his attention.
“[The reporting party’s son] stated that he turned over in bed to greet the dog and observed Zygmunt in the second-floor bedroom with his pen*s outside of his underwear and was stroking it in a sexual manner with his attention focused on the other family dog,” Officer Torrence said. “The involved dog is named [name redacted], who is a female two-year-old German Shepard/Mastiff mix. [The reporting party’s son] stated that Zygmunt was speaking sexually to the dog while touching it inappropriately, repeatedly saying, ‘Give daddy your pu$*y, give me your pu*$y, baby.’”
According to police, Zygmunt J. Zybert III, 72, is a resident of Allen Street in Haverhill, MA. Court records indicate Zybert, who works as a general contractor, is divorced and was born in El Paso, Texas.
“When asked to elaborate on the inappropriate touching that occurred between Zygmunt and [the dog], [the reporting party’s son] stated that Zygmunt was ‘f*nger*ng’ [the dog’s] genitals,” Officer Torrence said. “When asked if he saw Zygmunt’s finger inside of [the dog’s] genitalia he stated ‘yes.’ [The reporting party’s son] stated that when he asked Zygmunt what he was doing he stated, ‘I don’t know,’ and abruptly left the room.”
Officer Torrence said the reporting party corroborated his son’s statements and went on to say that the family dogs never liked Zygmunt but he did not realize why until now.
“[The reporting party’s son] stated that Zygmunt had been drinking this morning and is intoxicated, which is most likely why Zygmunt did not notice him there. [The involved dog] had no visible injuries,” Officer Torrence said. “[The reporting party] stated that upon arriving back at the residence, he verbally confronted Zygmunt about the incident and recorded the confrontation on his phone. In the video, [the reporting party] asked Zygmunt why he would do something like that, to which he stated, ‘I don’t know, I’m just lonely. It’s my fault and my stupidity.’ In the video, Zygmunt went on to state that he originally had plans with a ‘woman who wanted to play with me, but she spurned me and I got lonely.’”
Officer Torrence said the video of the reporting party’s confrontation with Zygmunt was captured on his body worn camera and that officers on scene spoke with Zygmunt regarding the incident.
“Sergeant Mills advised Zygmunt of his Miranda rights before he was questioned about the incident,” Officer Torrence said. “Zygmunt was mildly intoxicated, but was coherent and able to answer all questions accurately. When asked what had occurred, Zygmunt stated that he and [the reporting party] were ‘having a disagreement about what I did.’ When asked to elaborate, Zygmunt stated that he ‘didn’t do anything, I came upstairs to let the dog…out and that’s it. The dog…didn’t want to go, so I went back down, and his son was in the bed and he surprised me. Now I’m getting accused of stuff.’”
Officer Torrence said Zygmunt was asked if he was touching himself or the dog while he was upstairs and he stated “no.”
“In a spontaneous utterance, Zygmunt stated, ‘I wasn’t fondling the dog, I could care less about dogs,’” Officer Torrence said. “When asked what he meant by this, Zygmunt changed his statement and stated, ‘I don’t fondle people, I’m a man.’ Officers on scene had not brought up inappropriately touching dogs at this point. Zygmunt was adamant that all he did was try to let [the dog] outside.”
Officer Torrence said that based on the fact that the reporting party’s son witnessed Zygmunt in the midst of sexual contact with their family dog, Zygmunt was placed under arrest.
“Zygmunt was handcuffed behind his back,” Officer Torrence said. “The handcuffs where double locked and checked for tightness.”
Zygmunt was then placed in the rear of a cruiser and transported to the Haverhill Police Department for booking.
Zygmunt J. Zybert III, 72, of Haverhill, was charged with the following:
- Sexual Contact with Animal, First Offense
Zybert was arraigned in Haverhill District Court on Aug. 7, 2026. Following his arraignment, he was released on $1,000 cash bail under the condition that he comply with the existing restraining order, stay away from his Allen Street residence, not have any contact with animals (possession, custody, or care), stay away from and not contact the victims and witnesses, and undergo mental health and substance abuse evaluations and treatment.
Zybert’s next court date is a pretrial hearing scheduled for Sept. 9, 2026.
