Fitchburg man arrested for indecent exposure and harassment order violation after exposing himself to his neighbor from his balcony

FITCHBURG — A 70-year-old Hartwell Street resident was arrested for violating a harassment prevention order and indecent exposure after exposing himself to his neighbor from his balcony on Sunday, August 11, 2024.

(The account and quotations in this article were sourced from the printed Statement of Facts in Support of Application for Criminal Complaint submitted to the Fitchburg District Court by Officer Matthew Pawson and do not reflect any political perspective or personal opinion of News Link Live, which is strictly a business entity.)

According to police, Adolph Mandes, 70, of 18 Hartwell Street, was arrested at Randolph Aubuchon Attorney’s Office, located at 16 Hartwell Street, following a confrontation with his neighbor, Jorge Andres Sarrazola Alvarez. The law office is just a short distance from Mandes’ residence.

According to Sarrazola Alvarez, who reported the incident to police, Mandes shouted, “It’s that motherf*cker again!” from his third-floor balcony, before disrobing himself and exposing his genitals to Sarrazola Alvarez and witness Robin Flamenco. Both Sarrazola Alvarez and Flamenco told police they were offended by the act.

The incident violated a harassment prevention order initially served to Mandes on May 10, 2024, and extended through May 23, 2025, which prohibited him from contacting or harassing Sarrazola Alvarez in any manner.

“Adolph violated the conditions of the harassment prevention order which details: ‘you are ordered not to harass the plaintiff,’” Officer Matthew Pawson of the Fitchburg police wrote in the Statement of Facts for the incident. “Adolph also violated the condition of the harassment prevention order which details: ‘you are ordered not to contact the plaintiff in person, by telephone, in writing, electronically, or otherwise, either directly or through someone else.’”

Mandes was arrested at Randolph Aubuchon Attorney’s Office and charged with indecent exposure and violating the harassment prevention order. Police confirmed Mandes’ identity on scene by using his New York driver’s license to conduct an RMV search.

Mandes’ bail was set at $5,000.

He was arraigned by Judge James Haddad in Fitchburg District Court on Aug. 12, 2024. Judge Haddad reduced Mandes’ bail to $200 during his arraignment.

Following his arraignment, Mandes was released on $200 bail and with a GPS bracelet, under the condition that he avoid any contact with Sarrazola Alvarez, and only leave his residence for medical or legal appointments. (The GPS bracelet is programmed with designated “windows” for these appointments, to ensure Mendes remains compliant with the conditions of his release).

Mandes attended a pretrial hearing on August 13, 2024, which was continued to August 29, 2024.

Disclaimer: If you are wondering why the incident in this story was from earlier this month, that’s because I had to file FOIA request(s) to get the court documents for the incident. FOIAs are time consuming.
