Leominster man arrested after yelling, honking, and accelerating toward officer at crash scene

LEOMINSTER — On Tuesday, May 27, 2025, at approximately 3:28 p.m., Officer Jonathan Ramos was on patrol in a fully marked cruiser on Whitney Street near the intersection of Spruce Street when he observed a long line of cars stopped in the southbound lane.

“Across from 167 Whitney Street, I observed a black motorcycle facing sideways in the southbound lane,” Officer Ramos said. Later adding, “This vehicle [i.e., the motorcycle] appeared to be disabled, as two men were attempting to move it manually off the roadway. Please note that due to this accident involving a motorcyclist there was a high probability of injury.”

Officer Ramos then activated the emergency lights on his cruiser and pulled forward.

“I began to collect information regarding the investigation of the apparent motor vehicle accident,” Officer Ramos said. “While doing so, a blue Subaru bearing Massachusetts registration plate [# redacted] was in the southbound lane. A male operator, later identified as Mr. Raul Martinez III, began yelling excessively out of the driver’s side of his window.”

Officer Ramos noted that he was the only officer on scene at that time and was awaiting backup. He also observed several civilians present, including the motorcycle operator and two women.

“I informed Mr. Raul Martinez that I was in the middle of my official duties, to which he replied, ‘F*ck you,’” Officer Ramos said. “Immediately after yelling this, a bystander stated, ‘What?’ expressing his annoyance.”

According to police, Raul Martinez III, 32, is a resident of Walker Street in Leominster, MA.

Officer Ramos said that Martinez was located an estimated 60 to 70 feet away from the bystanders.

“During this incident, I requested additional patrol units respond as well as a supervisor due to his increasing volatility,” Officer Ramos said.

Officer Ramos reported that Mr. Martinez was yelling very loudly and using vulgar language, which caused noticeable annoyance among nearby civilians.

“Other civilians present began looking in Mr. Martinez’s direction,” Officer Ramos added. “I was currently walking in the roadway near the double yellow lines. I terminated speaking with Mr. Martinez and returned to my investigation.”

Officer Ramos said that as he turned away from Martinez in an attempt to de-escalated the situation, Martinez accelerated toward him at a high rate of speed.

“I heard a vehicle behind me, belonging to Mr. Martinez, accelerating in my direction greater than what was reasonable, causing me to turn back around,” Officer Ramos recounted. “I observed Mr. Martinez to have significantly and intentionally closed the previous distance down to about 10 feet. Mr. Martinez, at this time, made no legitimate effort to go around me while operating this vehicle. Please note Mr. Martinez could have conducted a U-turn and utilized an adjacent street to go around the crash.”

The officer stated that Mr. Martinez continued yelling excessively, which again interrupted the ongoing investigation and assessment of possible injuries related to the accident.

“Mr. Martinez repeatedly interrupting my official duties served no legitimate purpose,” Officer Ramos said. “I instructed him again to keep his voice down, to which he responded with ‘f*ck you.’ Mr. Martinez then began using his vehicle’s horn to express his distaste for having to wait due a motor vehicle accident involving a motorcycle, impeding his lane of travel.”

Officer Ramos added that Martinez honked his horn “more than once.”

“This horn was not used as a warning device or for a legitimate purpose,” Officer Ramos said. “I warned Mr. Martinez that if he continued his conduct, he would be placed under arrest for disturbing the peace, to which he continued to reply with antagonistic responses.”

Officer Ramos said he then instructed the vehicles in the northbound lane to proceed forward in an effort to allow Martinez the opportunity to safely pass around the accident scene without incident.

“Mr. Martinez then quickly exited his vehicle, stood in the middle of the roadway, continued yelling, and refused to comply with my lawful commands,” Officer Ramos said.

The officer reported that Martinez advanced toward him, arguing while standing in the middle of the roadway.

“Due to the totality of his actions along with exiting the vehicle, I determined Mr. Martinez to be aggressive and tumultuous in nature,” Officer Ramos said. “Mr. Martinez, in doing so, left his vehicle unattended, ultimately creating a traffic hazard. I ordered Mr. Martinez to place his hands behind his back as he was being detained.”

Officer Ramos said that as he grabbed Martinez’s left arm to place him in handcuffs, he tensed up his muscles and did not comply with his ordered.

“I utilized contact controls to place his arm behind his back so he could be handcuffed,” Officer Ramos added. “I then assisted with escorting him to a cruiser to which he continued to be noncompliant.”

Officer Ramos said that as he was escorting Martinez to his cruiser, Martinez dropped his body and began dragging his feet.

“Mr. Martinez was subsequently placed into the rear of a cruiser, and a short time later, I placed him under arrest,” Officer Ramos said.

Martinez was charged with the following, Officer Ramos’ explanation for the charges are provided in quotations:

  1. Disturbing the Peace: “Mr. Martinez was unnecessarily yelling loudly and utilizing vulgar language, which resulted in numerous civilians being annoyed,” Officer Ramos said. “Mr. Martinez activated his horn numerous times to express his distaste. Mr. Martinez’s actions did not have a legitimate purpose and drew attention from civilians.”
  2. Disorderly Conduct (Subsequent Offense): “Mr. Martinez purposefully created a risk of public inconvenience and annoyance by acting in an agitated manner, exiting his vehicle while being verbally aggressive, closing the distance towards me and leaving the vehicle unattended in the middle of the roadway, thus creating a traffic hazard,” Officer Ramos said. Martinez was previously found guilty on a disorderly conduct charge in Leominster District Court in September 2010 and was ordered to pay a $50 fine.
  3. Assault with Dangerous Weapon: “Mr. Martinez, while my back was turned to him, took an overt action of accelerating his vehicle towards me,” Officer Ramos said. “Mr. Martinez intentionally closed the distance that was approximately 60 feet down to approximately 10 feet, thus coming reasonably close to committing a battery. Mr. Martinez did not make a legitimate effort to go around me, avoid where I was standing, or seek an alternative route.”
  4. Interfering with a Police Officer: “I was engaged in the lawful performance of my duties while assigned to a fully uniformed patrol post,” Officer Ramos said. “Mr. Martinez exited his vehicle, attempting to approach me while being verbally aggressive. Mr. Martinez was aware that I was in the performance of my duties and intended to hinder my investigation with his actions.”
  5. Improper Operation of a Motor Vehicle: “Mr. Martinez activated his horn in a harsh and unreasonable manner,” Officer Ranos said. “I have issued Mr. Martinez Massachusetts Uniform Citation [# redacted] and have mailed it to his registered address.”
  6. Resisting Arrest: “Mr. Martinez, when being lawfully detained, tensed his muscles, dropped his body weight and dragged his feet, using physical force to prevent the detention,” Officer Ramos said.

Martinez’s bail was set at $200 cash.

Martinez was arraigned in Leominster District Court on May 28, 2025. Following his arraignment, he was released on bail.

Martinez’s next court date is a pretrial hearing scheduled for July 11, 2025.
