AYER โ€” On Monday, July 7, 2025, at approximately 8:30 a.m., Officer Jared Splaine of the Ayer Police Department drove through the Caza Manor Motel’s parking lot located at 96 E Main Street while he was on routine patrol when he observed a white Chevrolet pickup truck with Home Depot markings on it โ€œand a large amount of various debris in the bed.โ€

โ€œI immediately recognized this truck as a rental belonging to Matthew Green, who is trespassed from 94-96 E Main Street and 12 -14 Page Street for threatening the property owner and damaging the property,โ€ Officer Splaine said. โ€œA Notice of Trespass was served in-hand to Matthew Green and Heather Smith on May 28, 2025, and a certified copy was returned to the agency signed by Constable Keith Keady.โ€

According to police, 37-year-old Matthew D. Green’s residential address is listed as 96 E Main Street, Apt. 5, Ayer, MA. Court documents indicate heโ€™s single and unemployed. Heather Smith, 34, who is Greenโ€™s girlfriend, has lived with him at the same address in Ayer.

Officer Splaine said that, as he continued to drive, he noticed that Green was now standing outside of the vehicle with the doors open.

โ€œMatt was stopped in this vehicle by Sergeant [Timothy] laleggio recently,โ€ Officer Splaine said. โ€œMatt and Heather were also seen together in this vehicle yesterday on CCTV [closed-circuit television] footage from a suspected illegal dumping incident.โ€

โ€œI confirmed the validity of the Notice of Trespass with dispatch,โ€ Officer Splaine said. Later adding, โ€œI then contacted Officer [Michael] Nicolo and Officer [Andrew] Gambrell to request their assistance. With all officers on scene, we proceeded to apartment 10A, which the truck was parked in front of. My body-worn camera was activated at this time. Matthew and Heather are friends with and frequent guests of the resident of 10A, Ryan [last name redacted].โ€

Officer Splaine said he knocked on the door of the apartment with no response, but when Officer Nicolo peered through the window he saw someone inside.

โ€œOfficer Nicolo yelled โ€˜come outside,โ€™โ€ Officer Splaine said. โ€œRyan [last name redacted] came to the door. Officer Nicolo and I told Ryan to go get Matt and Heather. Ryan retreated from the doorway and sat on the couch, leaving the door open. I asked Ryan again to go get Matt and Heather so that we wouldn’t have to walk all the way inside. Ryan said โ€˜you know how it is.โ€™ I told Ryan we were going to have to look for Matt and Heather in his home, and he shrugged. After multiple attempts to call Matt and Heather out of the adjacent room, Officer Nicolo peered through an interior doorway where he observed Matt and Heather hiding in the corner.โ€

Officer Splaine said after Officer Nicolo called Green and Smith out of the room, Green exited the room first, followed by Smith.

โ€œI informed Matt that he was violating his no-trespass order. I then placed Matt under arrest. I placed Matt in handcuffs (double-locked), checked for proper fitment, and conducted a search of his person for weapons and means of escape,โ€ Officer Splaine said. โ€œI then placed Matt in the rear of cruiser #34 for transport. In the meantime, Officer Nicolo and Officer Gambrell placed Heather under arrest for the same. A discussion was then had regarding whether the rental truck was lawfully situated. Dispatch attempted to reach out to property owner Steve [last name redacted], but he did not answer. Matt said that his boss, Eric [last name redacted], could come retrieve the truck because he was on the lease. The decision was made to allow the truck to remain on the property until Eric was able to retrieve it, or until Steve contacted the department regarding his wishes. Matt and Heather were then transported to the station.โ€

Green and Smith were both charged with trespassing.

โ€œMatt and Heather were booked by Officer Nicolo and Officer Gambrell according to department policy,โ€ Officer Splaine said. โ€œThey were then transported to Ayer District Court at 10:30 a.m.โ€
