โ€œThe caller was unable to confirm whether the male was conscious or not,โ€ Officer Champagne said. Later adding, โ€œAt approximately 12:06 a.m., Officer Brendan Rutherford, Officer Robert Champagne, Detective Christopher Cornelius and I arrived on scene, along with members of the Clinton Fire Department, [who arrived] shortly thereafter. While approaching the scene, I took notice of a male party lying face down on the side of the road in front of 68 Kilmurray Street, with no other individuals in the area.โ€

The man was identified as then 20-year-old John D. Lopresti.

โ€œOfficer Rutherford and I were able to wake Mr. Lopresti up, who was passed out on the grass in a puddle of what appeared to be his own vomit,โ€ Officer Champagne said. โ€œI began speaking with Mr. Lopresti who started to show signs of being disoriented, not knowing where he was. When asked where he thought he was, Mr. Lopresti stated, โ€˜Marlborough.โ€™โ€

At that point in the conversation, Officer Champagne said he detected a strong odor of an alcoholic beverage coming from Lopresti as he spoke and observed that his eyes were glossy, red, and bloodshot. Officer Champagne also took note of a motor vehicle parked in front of 57 Kilmurray Street with its headlights on, across the street from where Lopresti was lying.

Officer Champagne inspected the vehicle and noticed that it was off but still shifted in drive, so he quickly placed it in park.

According to police, the vehicle was a 2010 Infiniti EX35 with Massachusetts plates registered to a woman in Hudson, MA. The woman was later identified as Loprestiโ€™s mother.

โ€œWhen I illuminated the vehicle with my flashlight and asked if it was his, Mr. Lopresti stated it was,โ€ Officer Champagne said. โ€œAt this time, the Clinton Fire Department began evaluating Mr. Lopresti. While doing so, people from nearby residences began coming outside to report what they had witnessed.โ€

One of the witnesses said that he heard an engine revving outside his residence and then witnessed Lopresti coming in and out of the Infiniti numerous times. The witness added that Lopresti was alone while doing this.

โ€œHe then saw him leave the car and walk out of view behind a vehicle parked at the edge of his driveway, one that Mr. Lopresti had passed out next to,โ€ Officer Champagne said.

At that time, the Clinton Fire Department assisted Lopresti to his feet. He was very unsteady, so they rolled the stretcher to him, determining it was too unsafe for him to walk a long distance.

โ€œMr. Lopresti was going to be transported to the Clinton Hospital to be evaluated due to his level of intoxication,โ€ Officer Champagne said. โ€œWhile looking at the vehicle, there was a wallet in the car that had cards inside it with Mr. Loprestiโ€™s name. There was also a strong odor of alcoholic beverage emitting from the vehicle, like Mr. Loprestiโ€™s person. Spread all over the vehicle was also 14 empty Blue Raspberries 99 nip bottles, as well as two unopened ones. In the front passenger seat of the vehicle was also an unopened bag of Taco Bell with a DoorDash delivery receipt for [the Clinton policeโ€™s dispatcher] with an order placement time of 11:17 p.m.โ€

Officer Champagne contacted Clinton Police Department dispatcher [name redacted], who confirmed that the order Mr. Lopresti was attempting to deliver was intended for him at the Clinton Police Station.

โ€œ[The dispatcher] was able to show us text confirmations of the DoorDash app that Mr. Lopresti was his assigned driver to deliver his food and was able to track him on the app which showed him parked on Kilmurray Street,โ€ Officer Champagne said. โ€œBased on my observations to include the level of intoxication that Mr. Lopresti was displaying, his property inside the vehicle, the amount of opened and empty nip bottles, the confirmation of him delivering for DoorDash, and witnessesโ€™ statements, I formed the opinion that Mr. Lopresti was operating a motor vehicle under the influence of intoxicating liquor and was the only one possible to be the operator. At this time, I met the ambulance at the Clinton Hospital and advised Mr. Lopresti that he was under arrest for operating a motor vehicle was under the influence of liquor and for possessing liquor while being under 21.โ€

While Officer Champagne was at the hospital, a firefighter informed him that Lopresti told him he was working for DoorDash that night. Lopresti later told police that he DoorDashes every night until 5 a.m. as his job.

โ€œI read Mr. Lopresti his Miranda warnings from a card I keep on my person, as well as his Statutory Rights and Consent Form advising him that I was requesting him to submit to an evidentiary blood test, which he refused,โ€ Officer Champagne said. โ€œWhile reading him his Statutory Rights and Consent Form, Mr. Lopresti was having a difficult time understanding simple instructions, such as signing and dating the form.โ€

Officer Champagne said that since Clinton Hospital was busy and each emergency room was already filled, Lopresti was placed on a bed in the hallway.

โ€œAt this time, there were many other patients that were also placed in the hallway to include a female party directly behind Mr. Lopresti,โ€ Officer Champagne said.

Officer Champagne went back to the Clinton Police Department, added Lopresti into the booking system and contacted the bail commissioner, then returned to the hospital, where he was advised by Detective Cornelius that Lopresti had begun to make inappropriate remarks about the hospital staff.

โ€œHe continuously used derogatory language, such as the โ€˜N-wordโ€™ at a high volume, with African Americans nearby, and told nurses to โ€˜F*ck offโ€™ as they attempted to treat him,โ€ Officer Champagne said. โ€œThese visible actions disturbed and annoyed many of the staff as well as the patients that were trying to be treated, especially the female patient seated within 10 feet of Mr. Lopresti who seemed visibly disturbed by his actions.โ€

Officer Champagne added that these offensive utterances served no legitimate purpose.

โ€œWhile still lying on a bed in the hallway of the hospital, Mr. Lopresti purposefully began pulling down both his shorts and underwear, exposing his genitals to Officer R. Champagne, Detective Cornelius and me, leaving us offended by the exposure,โ€ Officer Champagne said.

Officer Champagne said that shortly after, Bail Commissioner Cathy George arrived at the hospital and bailed Lopresti out on personal recognizance.

โ€œWhile doing so, Mr. Lopresti called Mrs. George a Jew,โ€ Officer Champagne said.

After he was released, Loprestiโ€™s sister came to take custody of him.

โ€œHours after being in police custody, Mr. Lopresti was still highly intoxicated that he was unable to get out of bed and fell on the floor,โ€ Officer Champagne said, adding that Lopresti and his sister were then escorted to her vehicle so they could leave the hospital.

John Lopresti was charged with the following:

  • Operating a Motor Vehicle while Under the Influence of Liquor
  • Minor in Possession of Alcohol
  • Indecent Exposure (three counts)
  • Disorderly Conduct
  • Disturbing the Peace

Loprestiโ€™s license was also seized and destroyed.

โ€œA motor vehicle inventory was conducted per department policy and Guaranty Auto took possession of the vehicle involved,โ€ Officer Champagne said.
