Ashby man arrested for disorderly conduct at Fitchburg D’Angelo’s after disrupting businesses and yelling obscenities at police

FITCHBURG — On Tuesday, October 1, 2024, at approximately 8:01 p.m., Officer Ashely Perez of the Fitchburg Police Department was dispatched to the D’Angelo’s located at 516 John Fitch Highway following a report of a male party – later identified as Damon Wuth – harassing customers and staff.

According to police, Damon T. Wuth, 42, is a resident of 27 Mill Creek Drive, Apt. 2, Ashby, MA.

Officer Perez said that when she arrived on scene, she located Wuth in parking lot.

“Damon was acting very disorderly in the parking lot of D’ Angelo’s and was uncooperative with police, refusing to comply with any order like identifying himself,” Officer Perez said. “When asked to identify himself, he yelled, ‘NONE YA.’”

According to Officer Perez, when the individual refused to identify himself, he was identified as Damon Wuth by his Massachusetts ID, which was confirmed by dispatch via the Massachusetts Registry of Motor Vehicles.

Wuth repeatedly yelled “F$CK Y@U!” at the officers on scene and told the officer to “SUCK EACH OTHER’S D*CK” multiple times, Officer Perez added.

Officer Perez stated that Damon’s actions “disrupted” surrounding businesses, prompting both customers and employees to come outside, with some using their cell phones to record the incident.

“Damon’s action did affect the public because they became alarmed by Damon’s yelling, creating an inconvenience for business owners by disrupting their operations,” Officer Perez added.

Wuth was placed under arrest for disorderly conduct.

He was arraigned in Fitchburg District Court on Oct. 2, 2024.

Following his arraignment, Wuth was released on his own personal recognizance under the condition that he remain drug and alcohol free and submit to random drug/alcohol testing.

His next court date is a pretrial hearing scheduled for Nov. 4, 2024.

This isn’t the only arrest that’s taken place at the D’Angelo’s on John Fitch Highway recently.

According to police, on Monday, Sept. 30, 2024, Mark A. Pearl, 34, of 128 Rollstone Street in Fitchburg, was arrested at D’Angelo’s for violating a trespass order from the manager that was issued the day before.
