Dudley man arrested in Leominster for OUI after stop of construction van for obstructed plate

LEOMINSTER โ€” On Friday, Dec. 12, 2025, at approximately 9:33 p.m., Leominster Police Officer Kyle Klimowicz was conducting traffic enforcement near North Main Street and State Street when he observed a gray Honda Odyssey minivan traveling inbound on North Main Street with a flashing white light above the rear license plate.

โ€œI was only able to read the last three digits of the license plate, as the first three were obstructed by the inconsistent flashing light,โ€ Officer Klimowicz said. โ€œI drove behind the vehicle until I could read the entire license plate after multiple cycles of the light flashing to reveal the registration tag.โ€

Officer Klimowicz said he queried the registration of the minivan through the FBIโ€™s Criminal Justice Information Services (CJIS) database in the mobile data terminal of his cruiser, which came back to a 2011 gray Honda Odyssey registered to Piascik Construction Inc.

โ€œI activated my emergency blue lights and initiated a motor vehicle stop of the vehicle, which turned right from North Main Street into the parking lot of Wendyโ€™s,โ€ Officer Klimowicz said. โ€œNote that the vehicle came to a stop and parked across multiple parking spaces, inconsistent with how other vehicles were parked beside it. I approached the passenger side of the vehicle and made contact with the solo occupant and male driver, identified as Joshua Daniels.โ€

According to police, Joshua L. Daniels, 35, is a resident of Dudley, MA.

Officer Klimowicz said he told Daniels the reason for the traffic stop, and explained how the vehicleโ€™s rear license plate appeared obstructed by the sporadically flashing white light and that I was unable to read the license plate from within 60 feet.

โ€œJoshua explained that he was aware of the flashing white light, and noted that there is a steady light beside it,โ€ Officer Klimowicz said. โ€œI informed him that the amber rear light on the right side of the license plate only made the last three digits legible, and that the first three were unreadable. Upon first introducing myself to Joshua, it became immediately apparent to me that he had glassy, bloodshot eyes, and that his speech appeared slurred with drawn out annunciations. I observed an open cardboard case of Budweiser beer on the floor behind the front passenger seat with an unknown amount of cans still in it. Joshua informed me he was coming from dropping off an overnight bag to his girlfriend who was working overnight, and that he was at the construction site prior to that. He stated he was driving back to Dudley where he resides. I informed Joshua that I observed his glassy eyes, slurred speech, and an odor of an alcoholic beverage, even from the passenger side window. When asked how much he had to drink, or if he took any other substances tonight, Joshua affirmed he has been sober from Percocet for years, and that he had three to four beers approximately 1.5 hours ago.โ€

Daniels stated that he drank Budweisers at the job site in Dudley and remained there until approximately 7:30 p.m., Officer Klimowicz said. He noted the traffic stop took place at approximately 9:30 p.m.

โ€œI informed Joshua that given my aforementioned observations, I wanted to ensure he was able to operate a vehicle safely going forward and was not operating under the influence,โ€ Officer Klimowicz said.

Officer Klimowicz asked Daniels if he was comfortable performing Standardized Field Sobriety Tests (SFSTs), or taking a portable breath test (PBT).

โ€œI advised him that itโ€™s within his rights to refuse to do either of them,โ€ Officer Klimowicz said. โ€œI clarified for Joshua that if he submitted to the PBT and blew over a .08%, he would be arrested for Operating Under the Influence of an Intoxicating Liquor above the statutory limit.โ€

Officer Klimowicz told Daniels that if he took the PBT and blew under the statutory limit, or submitted to the SFSTs and there was no concern about his ability to operate a motor vehicle safely, he would be all set.

โ€œJoshua appeared more inclined to submit to a PBT, to which I advised Joshua I would give him a few minutes to think about what he wanted to do,โ€ Officer Klimowicz said.

At that time, Officer Klimowicz said he called Sergeant John Bouchard and briefed him on the circumstances, including the reason for the motor vehicle stop and his observations โ€” including Danielsโ€™ apparent slurred speech, glassy eyes, the odor of an alcoholic beverage when he spoke, and a case of Budweisers in plain view.

โ€œI requested a PBT be brought to the scene and was informed Officer [Noah] DeCesare would be in route to bring one from the station,โ€ Officer Klimowicz said. โ€œOfficer [Renzo] Vasconcelos was requested to the scene, in the event Joshua decided he would like to do SFSTs rather than the PBT without the PBT being on scene yet.โ€

According to Officer Klimowicz, when Officer Vasconcelos arrived on scene, he spoke with Daniels, who revealed more about his alleged drinking earlier in the day.

โ€œI overheard Joshua telling Officer Vasconcelos that he had consumed an โ€˜Eddyโ€™ nip along with the beers, earlier,โ€ Officer Klimowicz said. โ€œJoshua affirmed he would like to submit to the PBT, and was asked to step out of the vehicle.โ€

Officer Klimowicz said Daniels was advised of the portable breath test process and what the results would entail.

โ€œOfficer DeCesare administered the PBT to which Joshua blew a .129% BAC [blood alcohol concentration],โ€ Officer Klimowicz said. โ€œJoshua was then advised by Officer Vasconcelos that he would be under arrest for OUI Liquor.โ€

Officer Vasconcelos then transported Daniels to the Leominster Police Department for booking while Officer Klimowicz remained on scene to request a tow of the vehicle.

Before the vehicle was towed by Quality Towing & Recovery, Officer Klimowicz said he conducted an inventory of the vehicle and located two largely empty Deep Eddy lemon vodka nips in the driverโ€™s-side door pocket, which he said still contained โ€œliquid remnants.โ€ Officer Klimowicz also said he found four empty Budweiser beer cans in the driverโ€™s-side door pocket, consistent with a cardboard Budweiser 30-pack case on the floor behind the passenger seat.

โ€œThat cardboard Budweiser case contained four empty beer cans, one opened/half full Budweiser can, and two sealed cans,โ€ Officer Klimowicz said.

Officer Klimowicz said he found an empty Dr. McGillicuddyโ€™s root beer-flavored nip in the rear pocket of the front passenger seat. He also said an empty menthol mint-flavored Dr. McGillicuddyโ€™s nip was located in the left rear passenger seat pocket.

Officer Klimowicz said that, at the station, Daniels was advised of his rights to refusal, and he submitted to an evidentiary breath test.

โ€œThe evidentiary breath test was administered by Officer [Patrick] Doherty and the results showed a reading of 0.14% BAC,โ€ Officer Klimowicz said.

Danielsโ€™ Massachusetts driverโ€™s license was subsequently seized and he was provided a copy of the Notice of License Suspension for Chemical Test Failure form, Officer Klimowicz said.

Joshua Daniels, 35, of Dudley, was charged with the following violations/offenses:

  • OUI Liquor or .08%
  • Open Container of Alcohol in Motor Vehicle
  • Number Plate Violation

Daniels was arraigned in Leominster District Court on Dec. 15, 2025. Following his arraignment, he was released on personal recognizance. His next court date is a pretrial hearing scheduled for Jan. 22, 2026.
