Two arrested at Gardner Eagles club for violating harassment prevention orders protecting the same woman

GARDNER โ€” On Sunday, Dec. 7, 2025, Gardner Police Officers Bryant Powlowski and Officer Marcus Guerreiro were dispatched to the Fraternal Order of Eagles club located at 71 City Hall Avenue following a report of a violation of a harassment prevention order.

โ€œThe calling party, [name redacted], called in stating she was at the Eagles, and two people she had harassment prevention orders against were there and refused to leave even after knowing she was also at the establishment,โ€ Officer Powlowski said.

Officer Powlowski said the two individuals the reporting party had harassment prevention orders against were Tyler Hagar, 25, of Gardner, who was described in the report as female, and Krysta Smith, 31, of Baldwinville.

โ€œBoth orders are still active and state that both female parties were to remain 100 yards away from [the protected party],โ€ Officer Powlowski said. โ€œUpon arrival at the Eagles, Officer Guerreiro and I spoke with unnamed witnesses in the crowd.

According to Officer Powlowski, one witness said that the protected party was standing behind her in line, while the other two individuals were in the front of the line.

 โ€œThe distance between the front of the line and where she was standing was not a length of 100 yards away,โ€ Officer Powlowski noted. โ€œAt this time, I went inside to try to make contact with Krysta and Tyler, as they were still on scene.โ€

Officer Powlowski reported that upon entering the Eagles, he was informed the protected party had been allowed to go inside, retrieve some items, and leave in order to avoid escalating the situation.

โ€œ[The protected party] chose to oblige this request and be the bigger person, obtaining Christmas gifts and leaving the event, even though she had every right to remain,โ€ Officer Powlowski said.

Officer Powlowski stated that Hagar and Smith were required to leave upon incidental contact under the terms of the order, and that failing to do so constituted a violation of the 258E harassment prevention order.

โ€œUpon walking out, Krysta and Tyler were standing at the Eagles’ front door,โ€ Officer Powlowski said. โ€œI asked them what was going on and was told that [the protected party] showed up at the event after the two had already been there, and they both stated they were not leaving. At this time, I asked Krysta and Tyler if they were aware of the active orders against them, and they both said yes, but they were there first.โ€

Officer Powlowski said he advised Hagar and Smith that, regardless of who arrived first, they were required to leave the premises if the protected party appeared, or they would risk violating the orders they were under.

โ€œBoth female parties continued to argue with me about being there first and insisted I was wrong,โ€ Officer Powlowski said. โ€œAt this time, I advised Krysta and Tyler that by remaining at the event, they had violated the order and committed an arrestable offense.โ€

Officer Powlowski said he asked both individuals to step out of line, and they complied. He reported that Smith was handcuffed, double-locked, and transported to the Gardner Police Department by Officer Guerreiro. Officer Powlowski then handcuffed Hagar, double-locked the restraints, and transported her to the Gardner Police Department for booking.

โ€œBoth Krysta and Tyler were transported to the Gardner Police Department and booked by Sergeant [Russell] St. Pierre on the charge 258E/9, violation of a harassment prevention order,โ€ Officer Powlowski said. โ€œBoth female parties were booked and placed separately in cells 2 and 3 to await bail.โ€

Tyler Hagar, 25, of Gardner, was arrested and charged with:

Krysta Smith, 31, of Baldwinville, was arrested and charged with:

  • Harassment Prevention Order, Violate

Their arraignments were scheduled for Dec. 8, 2025, in Gardner District Court.
