Gardner man accused of kicking cop, spitting blood during late-night intoxication incident on Acadia Road

GARDNER โ€” On Saturday, December 20, 2025, at approximately 12:43 a.m., Officers Frimpong Antwi and Dennis Siaw of the Gardner Police Department were dispatched to 21 Acadia Road following a request to remove an individual who was “heavily intoxicated and causing a disturbance.”

When the officers arrived on scene, they met with the reporting party, Eric, in the driveway, who told police that he wanted his friend, Carlos Brittain removed from the residence due to Brittain’s “uncontrollable behavior.”

According to police, Carlos M. Brittain, 24, is a resident of Gardner, MA.

“Eric, who has been living with Carlos for the past two years, told me he had just returned from work at around 10:28 p.m. and decided to share a drink with Carlos,” Officer Antwi said.

According to Officer Antwi, Eric said Brittain then pushed him down onto the couch after he had asked Eric to stop drinking alcohol for the night.

“This encounter occurred after Carlos had consumed ten nips of whiskey in a row, which had an alcohol concentration of about 61.2%,” Officer Antwi said.

Officer Antwi said he and Officer Siaw then observed Brittain standing in the front doorway of the house. As the officers approached him, Officer Antwi said Brittain ran inside the residence and locked the door behind him.

Officer Antwi said he and Officer Siaw were able to enter the residence after, “a brief push at the door.”

“We met Carlos in the kitchen/dining area, extremely intoxicated, with bloody lips and blood dripping from his face, with blood stains all over his shirt, which was from him smashing his head into the walls and also hitting his face to the ground due to his intoxication level,” Officer Antwi said. “I requested EMS on scene to have him checked out.”

Officer Antwi said that as he attempted to speak with Brittain, Brittain refused to follow instructions and began yelling and calling the officers names.

“Carlos then started moving away from us, heading under the dinner table, and refused to come out when he was
instructed to,” Officer Antwi said. “He was advised several times to come out, but refused, so we found a way to pull him out, sit him down on the kitchen floor, and place him in handcuffs.”

Officer Antwi said that while Brittain sat waiting for EMS to arrive, he continued yelling at officers and acting disorderly, stating that he would โ€œf*ck us up.โ€

โ€œHe continued yelling at officers and creating a hazard in a physically offensive and unconducive manner,” Officer Antwi said.

Officer Antwi said that for officer safety and to prevent Brittain from further harming himself, he moved Brittain out of the house to the front entrance toward the driveway.

Officer Antwi said that after relocating Brittain, โ€œhis attitude and actions worsened” and he become “extremely uncalm and uncontrollable.โ€

“He started yelling at Eric and Eric’s sister, also on scene, calling them names in an offensive language, and refused to keep moving along with officers to where we would meet EMS,” Officer Antwi said. “He began acting unreasonably disruptive, yelling at them even louder than he did at officers inside the house. He kept going on, yelling and exhibiting abusive gestures.”

Officer Antwi said Brittain began kicking at Officer Siaw, who was standing at an angle closest to where Brittainโ€™s legs could reach. Officer Antwi said that Brittain then spat blood at him and Officer Siaw, and that his behavior remained unchanged as EMS arrived on scene.

“His behavior was so inappropriate, unpredictable, and endangering that the EMS staff feared getting close to provide first aid and clean off his facial wounds,” Officer Antwi said.

Officer Antwi said that at this point, Brittain was placed under arrest and secured in the back of a cruiser.

Officer Antwi said that Brittain was transported to the police station and booked by Sergeant Roger Cormier. He added that during booking, Brittainโ€™s behavior and attitude remained unchanged, and he was placed in a holding cell. He was later administratively booked.

Carlos Brittain, 24, of Gardner, MA, was charged with the following:

  • Disorderly Conduct
  • Assault & Battery on Police Officer
  • Assault & Battery

Brittain was arraigned in Gardner District Court on Dec. 22, 2025. Following his arraignment, he was released on personal recognizance. His next court date was a pretrial hearing scheduled for Feb. 12, 2026.
