Leominster man accused of civil rights violation after open bottle report at Allen’s

LEOMINSTER — On Monday, April 13, 2026, Leominster police responded to Allen’s Department Store at 26 Main Street following a report of a liquor law violation.

According to Leominster Police Capt. John Fraher Jr.’s personnel narrative for the incident, as a result of the call, Henry Sun was charged with disorderly conduct, an open container ordinance violation, and a civil rights violation.

According to police, Henry Somers Sun, 28, is homeless in Leominster, Massachusetts.

Captain Fraher wrote that Sun was also placed into protective custody “due to his level of intoxication” and because he was “unable to care for himself.”

According to the criminal docket for the incident, Sun was ultimately charged with:

  • Disorderly Conduct
  • Miscellaneous Municipal Motor Vehicle Ordinance/Bylaw Violation

Sun was arraigned in Leominster District Court on April 14, 2026. Following his arraignment, Sun was committed under Section 35, a Massachusetts law that allows a qualified person to request a court order requiring someone to be civilly committed and treated involuntarily for an alcohol or substance use disorder.

Sun’s next court date was a pretrial hearing scheduled for May 22, 2026.

Although Captain Fraher’s personnel narrative referenced a civil rights violation, the criminal docket reviewed by News Link Live did not list a civil rights violation among the charges against Sun.
