Leominster man arrested for exposing himself to woman while urinating in handicap parking space at Cumberland Farms

LEOMISNTER โ€” On Friday, May 22, 2026, Leominster Police Officer Phillip Allain was dispatched to 128 Fourth Street following a report of a male who displayed his penis while at Cumberland Farms at 454 Mechanic Street.

โ€œUpon arrival, I spoke with the reporting party, Jaimie [last name redacted] who stated that while she was in her car at Cumberland Farms, a male stared at her while he pulled his penis out through his left pant leg and urinated in the parking lot while maintaining eye contact with Jaimie and licking his gums, teeth, and lips,โ€ Officer Allain said.

Officer Allain said Jaimie described the man as white, of medium height and skinny build, with a scruffy beard. He was wearing a dark-colored sweatshirt, light khaki plaid shorts, and a hat.

โ€œJaimie stated that the act was alarming and she was grossed out and disgusted by it,โ€ Officer Allain said. โ€œJaimie stated that she left as she was calling police because she did not want to be around the male.โ€

Jaimie told Officer Allain she would go to Cumberland Farms to identify the man if he was still there.

โ€œUpon arrival at Cumberland Farms, Jaimie stated she did not see the male there and proceeded to point out the spot where he urinated,โ€ Officer Allain said. โ€œIt was at the top of a handicap parking space. Jaimie stated he was standing on the sidewalk in front of the building and urinated into the parking space.โ€

Officer Allain said there was a noticeable wet spot in the parking space and on the curb of the sidewalk, consistent with urination.

โ€œI advised Jaimie that since the male wasn’t on scene, she could go home, and I would contact her with any further questions,โ€ Officer Allain said. Officer Zachary Schaeffer โ€” who responded to the scene to assist โ€” checked the surrounding area for the man, while Officer Allain went inside Cumberland Farms to speak with the employee.

โ€œI asked the employee if he saw the incident happen, he stated no,โ€ Officer Allain said. โ€œI asked if I could see camera footage. He stated that only the manager has access to the cameras and won’t be back in until Monday.โ€

Officer Allain said that while was at Cumberland Farms, Sergeant James McKenna called him and asked for the description of the suspect.

โ€œI provided him with the description given to me by Jaimie,โ€ Officer Allain said. โ€œSergeant Mckenna then sent a booking photo from the supervisor cell phone to my work email and asked if the male pictured was the suspect. I advised him that the description matches, but the victim has gone home, so I would need to speak with her again.โ€

Officer Allain said he went to Jaimieโ€™s residence, showed her the photo, and asked if it depicted the man she saw in the parking lot.

โ€œJaimie stated that it was the male and appeared to hyper focus on the shorts that were the same,โ€ Officer Allain said.

Police identified the suspect as Zachary C. Devito, 34, a resident of N Main Street, Leominster, MA.

Officer Allain said Devito was arrested earlier in the day, at approximately 4:52 p.m., and charged with open and gross lewdness and two counts of assault and battery.

โ€œZachary was released from the Leominster Police Department at approximately 9:00 p.m.,โ€ Officer Allain said. โ€œThe photo shown to Jaimie was a photo from Zacharyโ€™s booking process for this arrest.โ€

Officer Allain requested a summons for Devito for a charge of open and gross lewdness.

Devito was arraigned in Leominster District Court on May 26, 2026. Following his arraignment, he was released on $1,000 cash bail. His next court date was a pretrial hearing scheduled for June 18, 2026.
