Leominster man charged with assault for reversing vehicle while his wife was in the doorway during separation dispute

LEOMINSTER โ€” On Monday, October 7, 2024, at approximately 11:37 a.m., Officer Noah DeCesare and Officer Patrick Flory of the Leominster Police Department were dispatched to 22 Portland Avenue following a report from a woman who said she had almost been run over by her husband.

โ€œUpon my arrival, I met with the husband later identified as Jason Newton who had been waiting outside,โ€ Officer DeCesare said. โ€œMr. Newton brought to my attention that he had been married to his wife later identified as [first name redacted, she will be referred to as โ€˜Mrs. Newtonโ€™ for the remainder of the article] Newton for 14 years. He stated that they have had hiccups in the past but within the last year, they have had problems where they had been separated. He explained that since moving back into the house there had been problems between him and Mrs. Newton to which she informed him to get out of the house.โ€

According to police, Jayson R. Newton, 30, is a resident of 22 Portland Street, Leominster, MA.

 โ€œMr. Newton went on to mention that today he had realized that their shared bank account which had around $800 in hit had been drained and he claimed that he needed to get a storage container and personal necessities as he was moving out of the house,โ€ Officer DeCesare said. โ€œAfter he had seen this, he admitted to taking a Dyson Airwrap a hair styling tool valued between $300 and $600] which he gifted to Ms. Newton as he was going to try and sell it as he claimed Mrs. Newton to have drained their bank account.โ€

While Jayson was loading items into his car, he stated that his wife returned home and attempted to retrieve her belongings from his vehicle.

โ€œMr. Newton claimed that when he had been trying to leave, she opened the door to his vehicle attempting to search for her Dyson while he was reversing in the driveway,โ€ Officer DeCesare said.

According to Officer DeCesare, Jayson also disclosed that, after this incident, he went into Mrs. Newton’s car and took a backpack belonging to her, adding that he recognized this act as childish.

Officer DeCesare then spoke with Mrs. Newton while Officer Carlos Cintron and Sergeant Juan Ramos โ€“ who had also responded to the scene โ€“ remained outside with Jayson.

โ€œMs. Newton stated to me how she and her husband were going through a separation in their marriage,โ€ Officer DeCesare recounted. โ€œShe stated how today she had informed Mr. Newton to leave the house as his name was no longer on the lease to the house.โ€

Mrs. Newton then stated that Mr. Newton accused her of draining their bank account, after which he informed her that he planned to take back the Dyson Airwrap he had given her and sell it.

Mrs. Newton said that as she returned home from work, Jayson was in the process of packing his car.

โ€œShe then stated that she opened the car door to his car in an attempt to retrieve the Airwrap he had gifted her,โ€ Officer DeCesare said. โ€œShe stated that at this time, while she had the car door open, Mr. Newton came out of the bulkhead to the basement and got in his car and attempted to reverse his car. She explained how while she was in the doorway she asked him โ€˜Are you serious?โ€™ to which he stopped to look at her and then did it again.โ€

Officer DeCesare added that Mrs. Newton said she was afraid of being injured by the door to the vehicle as Jayson was trying to back up. She then mentioned that at no time did her husband tell her to step away from the car or inform her that was going to move the vehicle.

โ€œAfter Mrs. Newton had got out of the doorway to the car, she stated how Mr. Newton had reversed and slammed on his brakes slamming the open door shut and then left the driveway speeding down the street,โ€ Officer DeCesare said. โ€œShe explained that after he had left, he had been trying to call her and then returned to the house and took a backpack out of her car which had her wallet and other personal belongings in it.โ€

After hearing this, Officer DeCesare told Mrs. Newton how to obtain a restraining order against her husband and then gave her a copy of an abused person’s notice of rights form, which she signed.

โ€œAfter talking to Mrs. Newton, I returned to Mr. Newton where I informed him that he was going to be placed under arrest for Assault with a Dangerous Weapon [to wit motor vehicle] on Mrs. Newton,โ€ Officer DeCesare said. โ€œMr. Newton was placed in handcuffs to the appropriate tightness and double-locked. Mr. Newton was then transported back to the police department for booking. While Sergeant Ramos and I were in the driveway, he brought to my attention that Mr. Newton claimed that his car was blocked in the driveway by his wife’s car. Please note that Mrs. Newton’s car was parked on one half of the driveway and not in the middle, appearing to not have been blocking Mr. Newton’s car.โ€

Officer DeCesare charged Jayson with one count of Massachusetts General Law Chapter 265 Section 15B Assault with a Dangerous Weapon [to wit motor vehicle]. Officer DeCesare explained the rationale for the charge, stating: โ€œMr. Newton assaulted his wife Mrs. Newton by means of his motor vehicle as she had been standing in the open doorway of his vehicle which he then reversed his car, putting Mrs. Newton in fear of being injured by the open door. Mr. Newton acknowledged this and then did the same act again.โ€

Jayson as arraigned in Leominster District Court on Oct. 7, 2024. Following his arraignment, he was released on his own personal recognizance under the condition that he stay away from/not contact his wife and not abuse her.

On Oct. 15, 2024, Mrs. Newton requested that the court amend the conditions of her husbandโ€™s release, which resulted in Judge Mark Noonan vacating all conditions except the no abuse order.
